Terms of Use

1. Parties and acceptance

These terms apply between you, the person using the Klaimira mobile app and klaimira.com (“Klaimira”), and Zihni Tunçsiper, who provides Klaimira (“we”). Contact: destek@klaimira.com. By accepting these terms and using the app you enter into this agreement.

2. The service

Klaimira is software that helps you collect and seal evidence when your flight is disrupted (delay, cancellation, denied boarding, downgrading, baggage), assess passenger rights under published rules (EU 261/2004, UK 261, Turkish SHY-Passenger Regulation, Canadian APPR, US DOT rules, Montreal Convention), prepare a claim letter and claim file (PDF), review a rejection letter and keep track of deadlines.

3. Not legal advice

Klaimira does not provide legal services or legal advice; it does not represent you before an airline, authority or court and does not send your claim on your behalf. The rights assessment is based on the information you enter and on published rules; whether you are entitled to anything, and how much, is ultimately decided by the airline, the competent authority or a court.

Amounts shown under the Montreal Convention and US rules are a liability limit, not a fixed amount owed. Claim and court deadlines vary by country. We recommend that you consult a lawyer before making an important decision.

4. Account

You need to sign in with Apple or Google to use Klaimira. Your account is personal; you are responsible for actions taken from your account and for the security of your phone. You can delete your account from within the app at any time.

5. Evidence and seal

The seal shows that a record has not been changed since it was sealed; it does not guarantee that the content of the record is true or that an authority or court will accept it as evidence. You are responsible for the accuracy of the information you enter and the documents you add. You may not use Klaimira to create false or misleading evidence.

6. AI drafts

The rejection letter analysis, the appeal draft and the letter narrative are produced with AI and may contain errors. Read them and correct them if necessary before sending. AI does not decide entitlements, amounts, articles or authorities; these come only from the app’s rights engine.

7. Plans and purchases

  • Free plan: collecting and sealing evidence, rights assessment, deadlines and reminders, summary PDF, airline statement classification; evidence backup and server attestation for one trip; while the live tracking feature is switched on, live tracking of one flight at a time.
  • Klaimira Single File: a one-time, non-renewing purchase. It unlocks the full claim file (PDF), the claim letter and the rejection letter analysis for the one claim you choose. It does not unlock baggage claims.
  • Klaimira Pro: a yearly, auto-renewing subscription. It unlocks these tools for all claims, evidence backup (within a per-account storage quota) and server attestation for all trips, while the live tracking feature is switched on, live tracking of several flights at a time, baggage claims and family passengers (you and 5 others).
  • Price: the price shown on the purchase screen and in the store applies. Payment is taken from your App Store or Google Play account.
  • Auto-renewal: Pro renews automatically for the same period unless cancelled at least 24 hours before the end of the current period; the renewal is charged to your account at the end of the period according to the store’s rules (on the App Store, within the 24 hours before it ends). You can manage and cancel your subscription in your store account’s subscription settings; cancellation takes effect at the end of the paid period. Deleting the app or your account does not cancel the subscription.
  • Restoring: your purchases are linked to your account. They come back when you sign in with the same account on a new phone, or with “Restore”.
  • Refunds: refunds are handled by Apple or Google under their own policies; we cannot issue refunds directly. If a purchase is refunded, or cancelled and revoked, the features it unlocked are locked again; files you generated earlier are not deleted from your phone.
  • Expired Pro: when Pro expires, new Pro-only actions are locked; files you generated earlier and your records stay available.
  • Your mandatory statutory rights as a consumer are not affected.

8. Rules of use

You may use Klaimira only for lawful purposes, for your own trips and for passengers whose details you are entitled to enter. You may not try to disrupt the service, get around its limits, access another person’s account or overload the server with automated tools. Reasonable usage limits (request and storage quotas) apply to every account.

9. Availability

Flight data comes from third-party sources and may be delayed, incomplete or wrong. When live data is not available you can enter times manually. Sync, backup, attestation, flight verification and AI need an internet connection. We try to provide the service without interruption but cannot guarantee it; the service may stop temporarily for maintenance or because of a failure.

10. Intellectual property and your content

The app’s software, design and texts belong to us; you receive a personal, non-transferable, non-exclusive licence to use them. The records you enter and the files you upload belong to you; we process them only to provide the service.

11. Liability

Klaimira is provided “as is”. Except for intent and gross negligence and cases in which the law does not allow liability to be limited, we are not liable for the outcome of your claim, missed deadlines, errors in third-party data or indirect damage.

12. Termination

You can end this agreement at any time by deleting your account. If you seriously breach these terms, we may restrict or end your access, with prior notice where possible; in that case we give you reasonable time to export your data.

13. Changes

We may update these terms. When they change, their version changes and the app asks you to accept the new version before you continue.

14. Governing law

These terms are governed by the law of the Republic of Türkiye. As a consumer you keep the mandatory protections of the law of your country of residence and your right to turn to the consumer bodies and courts there.

15. App Store and Google Play

If you downloaded the app from the App Store, Apple’s Standard Licensed Application End User License Agreement also applies. Apple and Google are not parties to these terms; maintenance, support and claims relating to the app are our responsibility.
